Terms of use: renewal reminders and landlord portal

What this page covers

This page sets out the terms for my free renewal reminder service and the landlord portal that goes with it. I'm Frankie, and the service is provided by my company, Bright Sparks of York Ltd. My full company details are at the bottom of this page.

These terms cover the free reminder service and portal only. If you book electrical work with me, that work is covered by the estimate and terms for that job, not by this page.

What the service is

It's a free record-keeping and reminder service. You tell me the renewal dates you'd like me to keep an eye on for your rental property, such as when an electrical report, gas safety record or EPC is next due, and I send you a reminder before each one comes round.

It's a courtesy service. I provide it free of charge, as a helping hand, and on a best-effort basis.

The most important bit

Your compliance dates remain your responsibility. My reminders are a backup to your own records, not a replacement for them. Whether or not a reminder arrives, the legal duties that come with letting a property stay yours, and the deadlines stay yours to meet.

What the service is not

It isn't legal, regulatory or compliance advice. I'm an electrician, not a solicitor. The reminders tell you about dates you've given me; they don't tell you what the law requires of you. If you're unsure what your obligations are, check them yourself or take proper advice.

Your dates come from you

Reminders are worked out from the dates you (or I, from records of work I've done for you) put in. If a date goes in wrong, the reminder will be wrong. Please check the dates shown in your portal and tell me if something doesn't look right, and I'll fix it.

No guarantee of delivery

I'll do my best, but I can't promise that every reminder will arrive, arrive on time, or that the service will always be available. Emails go astray, systems have outages, and spam filters do what spam filters do. Not receiving a reminder doesn't move any of your deadlines or change your obligations.

The service may change or end

Because it's free, I may change how the service works, or withdraw it altogether, at any time. If I make a change that matters to you, I'll tell you through the service itself (you'll see a "what's new" note or get a plain notice by email). If I ever withdraw the service, I'll give you reasonable notice so you can get your dates into your own records.

Fair use

In return for a free service, I ask that you:

  • give me accurate information, and keep it up to date;
  • use your sign-in links yourself and don't share them, as anyone with your link can see your reminder details;
  • use the portal and any booking links for their intended purpose, and don't attempt to access anyone else's information or interfere with how the service runs;
  • only give me personal details about another person (for example, someone at the property) where you're entitled to share them.

I may suspend or close a profile that's misused.

Liability

This is a free courtesy service, and my responsibility for it is limited accordingly:

  • I'm not liable for any loss caused by a reminder not being sent, not arriving, arriving late, or being based on incorrect information supplied to me.
  • I'm not liable for the consequences of relying on this service as your only record of your compliance dates.
  • I'm not liable for losses caused by the service being unavailable, changed or withdrawn.

Nothing in these terms excludes or limits my liability for death or personal injury caused by my negligence, for fraud, or for anything else the law doesn't allow me to exclude. Nothing here takes away rights you have by law as a consumer, and nothing here changes the terms of any separate contract you have with me for electrical work.

Your privacy

How I handle your personal information is set out in my privacy notice, which is the single place that describes it. When you signed up, you were shown what I collect and why; that notice, not this page, governs your data.

Stopping the service

You can stop at any time, and it's as easy as starting was: reply STOP to any reminder, or ask me by email. When you do, I'll stop the automated messages and delete the renewal details you've given me for the service. If you'd rather keep your dates on file and just hear from me less, say so instead and I'll sort that.

Governing law

These terms, and the service, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK, this doesn't take away protections you're entitled to where you live.

Changes to these terms

If I update these terms, the new version appears here with a new version number and date, and I'll flag material changes through the service's "what's new" notice. The version that applies to you is the one in force when you use the service.
